Terms of Service

These Terms govern your use of the Snagly application for macOS ("the App") and the website at snagly.orkut.ovh ("the Site"). By purchasing, downloading, or using the App, you agree to these Terms.

1. Licence

Upon purchase, you are granted a personal, non-exclusive, non-transferable licence to install and use the App on Macs you own or control. You may not resell, redistribute, rent, or sublicense the App, nor remove or bypass its licensing.

2. Purchase & price

The Direct (web) edition is sold for a one-time fee shown at checkout (currently $1.99). The Mac App Store edition is sold and billed by Apple under its own terms. Prices may change for future purchases; a purchase already made is unaffected.

3. What the App does

The App downloads files you choose, using parallel connections, browser integration, and — in the Direct edition — torrent and magnet links. You are solely responsible for the content you download and must comply with all applicable laws and third-party rights, including copyright. The App is a general-purpose tool and is not intended to facilitate infringement.

4. Acceptable use

You agree not to use the App to infringe others' rights, to distribute malware, or in any unlawful manner. You will not reverse-engineer, decompile, or tamper with the App except where such restriction is prohibited by law.

5. Accounts

Activation uses a passwordless e-mail code. You are responsible for the security of the e-mail account you use. You may delete your account and associated data at any time from within the App or by contacting us.

6. Updates & availability

We may release updates and may change or discontinue features. We aim to keep the Site and licensing service available but do not guarantee uninterrupted or error-free operation.

7. Warranty disclaimer

The App and Site are provided "as is" and "as available", without warranties of any kind to the fullest extent permitted by law. This does not exclude any statutory consumer rights you may have.

8. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect or consequential loss, or for loss arising from files you choose to download. Nothing here limits liability that cannot be limited by law.

9. Termination

These Terms apply while you use the App. We may suspend access for breach of these Terms. Your statutory consumer rights are unaffected.

10. Governing law

These Terms are governed by the laws of the Republic of Türkiye. Mandatory consumer-protection rules of your country of residence continue to apply.

Bu Şartlar, macOS için Snagly uygulamasının ("Uygulama") ve snagly.orkut.ovh adresindeki web sitesinin ("Site") kullanımını düzenler. Uygulamayı satın alarak, indirerek veya kullanarak bu Şartları kabul edersiniz.

1. Lisans

Satın alma ile size, sahibi veya kontrolündeki Mac'lere Uygulamayı kurma ve kullanma için kişisel, münhasır olmayan, devredilemez bir lisans verilir. Uygulamayı yeniden satamaz, dağıtamaz, kiralayamaz veya alt lisanslayamaz; lisanslamayı kaldıramaz veya atlatamazsınız.

2. Satın alma ve fiyat

Direct (web) sürümü, ödeme ekranında gösterilen tek seferlik bir ücretle (şu an 1,99 USD) satılır. Mac App Store sürümü, kendi koşulları kapsamında Apple tarafından satılır ve faturalandırılır. Fiyatlar gelecekteki satın almalar için değişebilir; yapılmış bir satın alma etkilenmez.

3. Uygulama ne yapar

Uygulama, seçtiğiniz dosyaları paralel bağlantılar, tarayıcı entegrasyonu ve — Direct sürümünde — torrent ve magnet bağlantılarıyla indirir. İndirdiğiniz içerikten yalnızca siz sorumlusunuz ve telif hakkı dahil tüm geçerli yasalara ve üçüncü taraf haklarına uymalısınız. Uygulama genel amaçlı bir araçtır ve ihlali kolaylaştırmak için tasarlanmamıştır.

4. Kabul edilebilir kullanım

Uygulamayı başkalarının haklarını ihlal etmek, kötü amaçlı yazılım dağıtmak veya herhangi bir yasadışı biçimde kullanmamayı kabul edersiniz. Yasanın bu kısıtlamayı yasakladığı haller dışında Uygulamayı tersine mühendisliğe tabi tutmaz, kaynak koda dönüştürmez veya kurcalamazsınız.

5. Hesaplar

Etkinleştirme, şifresiz bir e-posta kodu kullanır. Kullandığınız e-posta hesabının güvenliğinden siz sorumlusunuz. Hesabınızı ve ilgili verileri Uygulama içinden veya bizimle iletişime geçerek istediğiniz zaman silebilirsiniz.

6. Güncellemeler ve erişilebilirlik

Güncellemeler yayınlayabilir, özellikleri değiştirebilir veya durdurabiliriz. Site ve lisans hizmetini erişilebilir tutmayı hedefleriz ancak kesintisiz veya hatasız çalışmayı garanti etmeyiz.

7. Garanti reddi

Uygulama ve Site, yasaların izin verdiği azami ölçüde, hiçbir garanti verilmeksizin "olduğu gibi" ve "mevcut haliyle" sunulur. Bu, sahip olabileceğiniz yasal tüketici haklarını dışlamaz.

8. Sorumluluğun sınırlandırılması

Yasaların izin verdiği azami ölçüde, dolaylı veya sonuç niteliğindeki zararlardan ya da indirmeyi seçtiğiniz dosyalardan doğan zararlardan sorumlu değiliz. Buradaki hiçbir hüküm, yasaca sınırlandırılamayan sorumluluğu sınırlamaz.

9. Fesih

Bu Şartlar, Uygulamayı kullandığınız sürece geçerlidir. Bu Şartların ihlali halinde erişimi askıya alabiliriz. Yasal tüketici haklarınız etkilenmez.

10. Uygulanacak hukuk

Bu Şartlar Türkiye Cumhuriyeti yasalarına tabidir. İkamet ettiğiniz ülkenin emredici tüketici koruma kuralları uygulanmaya devam eder.
